Mary-Kate Olsen is off the hook.

The feds have closed their probe into Heath Ledger’s death and won’t force the TV twin to tell them what she knows about his prescription drug stash, a source told the Daily News.

Prosecutors had kept an April 23 subpoena up their sleeves as they tried to convince Olsen to voluntarily speak with federal drug agents still probing Ledger’s January overdose, the source said.

Olsen had refused to talk without immunity to the Drug Enforcement Administration agents and federal prosecutors looking into the actor’s death in his SoHo flat.

By closing the case, Olsen won’t have to.

“A decision was made to close the case,” said a source familiar with the inquiry.

The U.S. Attorney of the Southern District decided not to serve Olsen with a subpoena, the source said.

Investigators had determined that Ledger, who stars as The Joker in “The Dark Knight,” had prescriptions for the Xanax, Valium and Restoril found in his system but none for the OxyContin or Vicodin.

Agents had wanted to ask Olsen if she knew how Ledger got these two potent drugs, sources said.

“We don’t know where he got the other narcotics. No one interviewed suggested (Olsen) gave him the drugs,” another source said. “But (Olsen) may have known where the drugs came from.”

Olsen, through her Manhattan lawyer Michael Miller, stated she “had nothing whatsoever to do with the drugs found in Heath Ledger’s home or his body, and she does not know where he obtained them.”

Miller, as well as spokespersons for the DEA and federal prosecutors, declined to comment on the status of the probe. Ledger’s two doctors - one in Texas and another in Los Angeles - cooperated with the inquiry.

So did ex-girlfriend Michelle Williams, sources said. Ledger’s masseuse had called Olsen when she found Ledger’s lifeless body in his Manhattan flat.

Instead of immediately dialing 911, the masseuse called Olsen, who called her bodyguards in Manhattan and told them to get to Ledger’s Broome St. apartment. The guards arrived as paramedics rolled up.

“There was no impropriety on the part of the doctors, they had actually examined (Ledger) and legitimately written the prescriptions,” another source said.

Mary-Kate To Be Subpoenaed In Ledger Investigation

As the investigation surrounding Heath Ledger’s accidental overdose continues, the federal Drug Enforcement Administration office in New York has confirmed to Access Hollywood that they have issued a subpoena that would force Mary-Kate Olsen to testify in front of a grand jury.

Five medications were found in Heath’s body at the time of his death, according to the DEA, three of which he’d obtained via doctors in Texas and Los Angeles. At the center of the investigation is how he acquired Oxycontin and Vicodin without a legal prescription.

The actress was the first person called by the masseuse who discovered Heath’s body after the “The Dark Knight” actor’s untimely death.

She broke her silence for the first time on Monday, when a rep for the actress told Access in a statement that she “had nothing whatsoever to do with the drugs found in Heath Ledger’s home or his body, and she does not know where he obtained them.”

However, despite the rep’s statement that they “have provided the Government with relevant information,” the actress is reportedly refusing to speak to government officials without immunity.

According to Benjamin Brafman, a high-profile defense attorney not associated with the case, seeking immunity is not the same as admitting guilt.

“It may not mean anything other than she’s getting good legal advice,” Brafman told Access.

“You don’t know what the DEA may suspect in this case and I think it’s a cautious way to proceed. I think it would be wrong to assume she’s done something criminal simply because she’s invoking her 5th amendment against self-incrimination.”

Pint-size actress Mary-Kate Olsen has refused to be interviewed by federal investigators probing the accidental drug death of her close friend Heath Ledger unless she receives immunity from prosecution, The Post has learned.

The actress’ lawyer has repeatedly rebuffed attempts by the feds to question Olsen, who was the first person called after her masseuse discovered Ledger’s body in his SoHo apartment in January.

Frustrated federal officials could obtain a grand-jury subpoena to compel the funky “Full House” actress to tell them whatever she knows about the “Dark Knight” star’s behavior, his possible drug use and the events of that fateful morning, according to sources.

Probers have interviewed everyone connected to Ledger and his death, including his doctors, the masseuse, bodyguards, housekeepers, business associates and even the mother of his 2-year-old daughter, Matilda, his “Brokeback Mountain” co-star Michelle Williams.

“Ms. Williams was extremely nice and cooperative,” a source said.

Another added, “Everyone has been very eager to help, saying what a great guy Heath Ledger was, everyone except Mary-Kate, who has refused to speak.”

That source explained that Olsen would be the final witness they need to conclude their investigation into where he got his drugs and medicines.

Ledger - whose performance as the Joker in “The Dark Knight” has ignited Oscar buzz - died of a potent cocktail of prescription drugs and OxyContin, the latter of which was likely obtained illegally.

His death was ruled an accidental drug overdose by the medical examiner.

And NYPD investigators closed their probe without interviewing Olsen because, they said, they got all the cooperation they needed from others. That decision, however, surprised some observers, considering Olsen’s role as a potential witness.

Instead of calling emergency responders after getting the call from her masseuse, Olsen telephoned her bodyguards in the Big Apple, telling them to race to Ledger’s Broome Street home, where they arrived just as paramedics got to the scene.

The US Drug Enforcement Administration, which opened an investigation to determine the sources of Ledger’s drugs, was not as sanguine as the NYPD about talking to the 4-foot-11, 90-pound Olsen.

The feds contacted her lawyer, Michael Miller, several times recently seeking her cooperation, but Miller has told the feds Olsen won’t be interviewed unless she gets immunity, exercising her constitutional rights.

According to sources, all of the drugs in Ledger’s body and discovered nearby in prescription bottles were legally obtained from two physicians - with the exception of OxyContin, a powerful painkiller.

Investigators “are trying to ID the source of the OxyContin,” a source said. “Did it come from a dealer, from a friend? If he had a bottle from a friend, was it taken by someone else before police responded? That is what is trying to be determined.”

The DEA probers were also aggressive with the NYPD, the sources said, and were forced to threaten to obtain a grand-jury subpoena before getting the department’s Ledger files.

An NYPD spokesman said the department never balked at handing over the files and did so after receiving a routine federal administrative subpoena.

Asked whether he asked for immunity for his client, Olsen’s lawyer said, “We are not going to comment on whether there is a criminal investigation,” and declined to speak further.

The sources said Ledger’s employees reached out to Olsen because they panicked at finding his body and did not know what to do.

As for the bodyguards, they claimed they responded only to offer help.

Mary-Kate and Ashley Olsen are gearing up to take the literary world by storm – or at least glam it up a little – with their upcoming coffee-table book Influence, and PEOPLE has a preview of its two covers.

One version of the 272-page hardcover book – due out Oct. 28 – will feature Mary-Kate on the cover, with Ashley on the back, while the other version swaps their positions.

“Ashley and Mary-Kate take readers on a journey through their celebrated young lives, pausing to reflect on what has helped shape them into who they are today,” the book’s publisher said in a statement. “They interviewed 20 people and wrote brief essays about each other. In each interview, the girls explore what inspired the interviewee.”

Those interviewed include fashion designers Karl Lagerfeld, Diane Von Furstenburg, John Galliano and Christian Louboutin, as well as model-actress Lauren Hutton.

“We interviewed the people who have inspired us, with the hope that they will inspire and teach others,” Mary-Kate said. “We want to explain culturally how ideas evolve.”

Chimed in Ashley: “We have filled Influence with the most interesting, challenging, creative people we know – the ones who helped pave the way for us and our generation.”

The book’s artwork includes photos and drawings provided by the interviewees, as well as never-before-seen photos from the 22-year-old twins’ private collections.

Spencer Pratt has apologized to Mary-Kate Olsen for calling her “the less cute twin.”

Pratt, 24, fired off a tersely-written statement to Usmagazine.com after Olsen, 22, told David Letterman The Hills star used to throw temper tantrums during their high school soccer games.

“I apologize for getting caught up in trash talking, but she brought up an emotional subject when she mentioned the soccer stuff,” Pratt tells Us exclusively.

“I know Dave was just doing his job in asking her,” he went on. “He’s the best in the game at that.”

Pratt even admitted he was a bit envious of the twin.

“I respect Mary Kate as a business-woman,” he said. “I’m secretly jealous of her. I want my face on a lunchbox, too!”

Sources told Us that the Olsen-Pratt fight began after he sold high school photos of a tipsy-appearing Olsen to Star magazine.

He’s a screen legend – heck, he’s even been knighted! But Sir Ben Kingsley isn’t above a little kiss-and-tell when it comes to his on-screen smooch with 22-year-old Mary-Kate Olsen in The Wackness.

“She was completely in charge,” the actor, 64, tells PEOPLE of their enthusiastic make-out scene in a telephone booth.

The former star of Gandhi and Schindler’s List – who’s currently shooting with Martin Scorcese in Boston – drove down to New York for the movie’s Cinema Society and Sony Cierge-sponsored party at the Gramercy Roof Club.

“I love watching the movie,” his wife, Daniela, said of the coming-of-age stoner film. As for her real-life leading man, she added, “I love him. He’s amazing.”

Writer/director Jonathan Levine said that although he was never a drug dealer, the film is loosely based on his own experiences growing up in New York. And even with this all-star cast, Levine still passed along a few valuable lessons.

Most notably? “I did have to teach Sir Ben how to take a bong hit.”

Although Mary-Kate and Ashley Olsen are fiercely private, details about the twins’ lives are slowly emerging. The latest: how the two achieve their signature smiles.

“Every time they pose and smile, they say the word ‘prune,’” a source close to the girls told OK!.

Another source close to the Olsens could not confirm the precise word they use as their smile trigger, but says their smiles are keys to their identity. “It could be true (that they say prune) but unfortunately I can’t say — they like to keep their personal lives personal,” said the source. “They do care about their smiles though. Mary-Kate has slightly thinner lips and more of a playful grin, while Ashley tends to go for a full-on pout. It has been the obvious way to tell them apart for years.”

In other Olsen news, Ben Kingsley opened up about working with 22-year-old Mary-Kate in a profile of the twins in Elle magazine. Kingsley and Mary-Kate share some racy scenes in their upcoming film, “The Wackness” (case in point: Kingsley, who is 64, is straddled by Mary-Kate in a phone booth in one scene).

“She was a joy to work with… I was quite taken by her, especially how astute she is about art. We spent a lot of time between takes talking about her art collection,” Kingsley told Elle. The film is scheduled for release July 3.

“I’m not going to comment on that,” Olsen, who turns 22 on June 13, tells Elle in its July issue. “I won’t give you a word about that in the nicest way possible. Let’s move on.”

The actress, who said in a statement last January that “Heath was a “friend” and “his death is a tragic loss,” also keeps mum about being a celebrity.

“It’s not a part of my life. It’s a media perception of who I am,” she tells the magazine. “It’s very weird. I mean, if I see a paparazzi shot of me walking that’s in a magazine or something at some event, it’s as if I see it from an outsider’s point of view. There’s like a character, almost, and then there’s me.”

Lapo, who now claims he has found sobriety through AA meetings in NYC, clung to life for three days in a coma before recovering.

“Mary-Kate and Lapo seemed very cozy” while sitting next to each other at the Giambattista Valli fashion show on Feb. 28, a source tells Star Magazine. “Lapo’s a good-looking guy, and Mary-Kate seemed to love the attention she was getting from him.”

Olsen, 21, and Lapo, 30, are certainly no strangers to each other. They have been linked many times together on the international party circuit.

“Perhaps, this time in Paris, they’ll strike up a romance,” adds the source.

The 81-year-old men’s magazine mogul - who originally asked the twins to model for him when they turned 18 three years ago - but was turned down - hopes the girls will accept his invitation to appear in a special June edition of his adult publication to mark their 22nd birthday.

A source said: “Hugh thinks the twins are every young man’s fantasy. But it might not be that easy getting them agree to pose for Playboy. They’re all about high-end fashion these days. They want to do Vogue.”

The legendary lothario also wants Lindsay Lohan to appear in his magazine - and recreate Marilyn Monroe’s famous naked swim from her ‘Something’s Got to Give’ movie.

Lohan recently stripped off in a New York magazine shoot to pay homage to Monroe. The racy shoot proved so popular that the magazine’s website crashed under the massive volume of hits.

Lohan, 21, paired with Monroe photographer Bert Stern to recreate the famous 1962 photo shoot of the blonde bombshell at the Bel Air hotel.

“Now we hear Lindsay is tempted to continue her nude homage to MM,” Liz Smith wrote in the New York Post earlier this week.

“Playboy’s Hugh Hefner has offered the young star the chance to re-create Marilyn’s famed nude swim from the unfinished film ‘Something’s Got To Give.’”

It will feature “the most interesting, challenging, creative people we know — the ones who helped pave the way for us and our generation,” Ashley said in a statement.

Among them: shoe guru Christian Louboutin, actress Lauren Hutton, photographer Terry Richardson and writer Bob Colacello.

“Ashley and I interviewed the people who have inspired us, with the hope that they will inspire and teach others,” Mary-Kate said.

The tired-looking star, hiding under a baggy sweatshirt, hat and sunglasses, arrived at LAX Airport from New York City Feb. 3.

Olsen, who was called four times by Ledger’s masseuse after he had died Jan. 22, told Usmagazine.com at the time: “Heath was a friend. His death is a tragic loss. My thoughts are with his family during this very difficult time.”

Us reported the pair “dated secretly and nonexclusively for the past four months.”

Days after his death, Olsen was spotted making out with artist Nate Lowman as her sister Ashley hit the fashion shows.

Cops Are Planning To Grill Mary-Kate!

Cops are planning to grill Heath Ledger’s pint-size paramour, Mary-Kate Olsen, about frantic phone calls she received from the masseuse who found him dead in his bed, The Post has learned.

It also emerged yesterday that the masseuse, Diane Lee Wolozin, had phoned Olsen four times using the “Brokeback Mountain” star’s cellphone - three before she even considered calling 911, police said.

Emergency workers arrived about 23 minutes after Wolozin first discov ered Ledger unresponsive in his bedroom near opened packages of pre scription pills, sources said.

Police investigators say they plan to inter view Olsen - who so far has said nothing publicly about her rela tionship with troubled star.

It was not clear whether she would fly to New York for the talk or if they would conduct the interview via a telephone call to California, where she has been holed up since the tragedy.

Cops planned to ask for her account of the cellphone calls she received from Ledger’s SoHo apartment, a source said.

The four calls were made during a nine-minute lag - before anyone thought to call 911.

Police also intended to ask Olsen, 21, why she sent a team of bodyguards to the apartment.

Wolozin, 40, telephoned Olsen after she and the actor’s housekeeper, Teresa Solomon, found Ledger face down on his bed. They had gone into his bedroom after he failed to respond to cellphone calls.

They were trying to rouse him for a scheduled massage appointment.

“Heath is unconscious. I don’t know what to do!” Wolozin screamed in her first call to Olsen, cops said.
Olsen replied, “I’m sending my private security there.”

Wolozin called Olsen again after finding Ledger was cold to the touch, and told the “Full House” star she was calling 911.
“I think he may be dead,” a shaken Wolozin said.

Olsen replied, “I already have people coming over.”

Certainly friends, definitely party pals and maybe more, Heath Ledger and Mary-Kate Olsen first met over the summer of 2006, at the time he was living at the Chateau Marmont in Hollywood, PEOPLE has learned.

More recently, “Mary-Kate and Heath were casually dating for three months before Heath’s death,” a source has told PEOPLE. “They were hooking up, but neither were particularly interested in making it exclusive.”

As for what drew the two together, says the source, “They had a bond that was based on partying, and they had the same tastes in partying … like, in terms of where they liked to hang out in New York, what time they would want to go out. They just had the same sensibility.”

At the time of their first becoming acquainted – the summer after Ledger’s Oscar nomination for Brokeback Mountain – Ledger and Olsen were spotted together having lunch at the Chateau with a group of friends, and Ledger was described as being charmed by Olsen, who made him laugh as he would scarf down a big meal.

“Mary-Kate made him laugh a lot,” an eyewitness recalled.

Both the New York Post and Daily News reported this week that Ledger, 28, and the Olsen twin, 21, were dating.

Linked By a Phone Call

Whatever their relationship, the two were again linked when reports surfaced that she received two phone calls from masseuse Diana Wolozin, who arrived for an appointment at the actor’s New York City apartment on Tuesday only to find him dead in his bedroom.

Wolozin, aware that Ledger and Olsen were friends, used the speed dial on Ledger’s cell phone to call Olsen in California to ask for help, sources said. Olsen told the masseuse she would call her security people in New York to assist in the matter.

Things were far more carefree back in the summer of ‘06, “They were all talking about scripts and telling funny stories about directors and people in the biz,” remembers the eyewitness. They also shared something else in common: Both smoked Marlboro Reds.

THE Sundance Film Festival kicked off in snowy Park City, Utah, yesterday with goofy, off-screen antics of the stars and directors just as entertaining as the movies being screened.

While audiences finally got to see that creepy kiss between Mary-Kate Olsen and Oscar-winner Ben Kingsley at the premiere of “The Wackness,” the hot buzz was the obsession one crew member had with the toothpick-thin twin.

Insiders say a production assistant fell madly in love with Mary-Kate during last summer’s shoot in New York. “He would do anything for her, get her tons of coffee, pay special attention to her, tell her stories, stare at her,” recalled our snitch at a party for the film this week at The Zone, which also hosted Maroon 5’s Adam Levine, Rex Lee and Le Cirque owner Sirio Maccioni.

“Eventually someone turned to him and said, ‘No one cares what you think.’ He was much better after that,” our insider laughed, adding that Olsen “does have a thing going with one of our producers. They have a date to make out.”

MARY- Kate and Ashley Olsen are groveling at the non-leather shoes of PETA after the animal rightists began a nasty campaign against the tiny fur-wearing twins. “The Olsens want to make peace with PETA,” one snitch told Page Six. The animal rightists dubbed them the “Trollson Twins,” named “Hairy-Kate” and “Trashley.” The Olsens’ rep had “no comment.”

THE animal-loving freaks at PETA are training their hate-beams on the Olsen twins, whom they’ve dubbed “The Trollsen Twins.” PETA is furious they’ve “ignored pleas to stop wearing fur and using it in their fashion collection.” The group is unveiling a campaign against the “fur fiends” — Mary- Kate (”Hairy Kate,” above) and Ashley (”Trashley”) — with a tag line: “Fur Is Worn by Beautiful Animals and Ugly People.” The Trollsen Twins poster will be unveiled today at their Walk of Fame star in LA.

JUST a week after being hospitalized with a kidney infection, Mary-Kate Olsen was out on the town. She hit the Bowery Hotel party for the new SoHo store Billion Dollar Boys Club on Wednesday and was seen dancing at 3 a.m. at the Beatrice Inn. “She looked fine to me,” one tipsy witness said. Meanwhile, twin Ashley - who is said to be “distant” from her sister - was at the party for the opening of the New Museum, where she cozied up to Josh Lucas during a performance by Cirque du Soleil star MC Raven O.
